The contempt of Court case at Ernakulam on JTO to SDE promotion:

CMD/BSNL and GM(Pers) (Respondent 1 and 2) shall appear before the Court in person on 27.08.2018.

In fact the contempt petition initiated on the plea that excess promotions done during 1996 to 1999 and their name is also included in the AIEL published on 14.06.2018. Surprisingly the applicant could not name a single JTO promoted in excess between 1996 to 1999 but simply go through the wording in the HC order on excess promotions. The excess promotion happened between 2001 to 2007 by diversion of quota which was quashed by Hon CAT, Chandigarh. While dealing about the matter in the Hon Ernakulam HC order, there is a mention about excess promotion from 1966 onwards.

The JTO to SDE promotion become a mess by the HC order as AIEL is not able to prepare. While strictly following the date of appointment as criteria, in some Circles 2002 rect JTOs become senior to 2001 rect JTOs as their date of appoint is earlier. Different Circles are interpreting the HC order in different manner and created more confusion. Now Pers section is seeking the advice of Estt section, the cadre controlling authority of JTO cadre, how to proceed. This contempt petition may further delay the promotions as management attention is now to come out of the contempt.

GS and AGS met CMD/BSNL on 26.08.18 and held further discussions on our demand for bringing parity and uniformity in promotions. In AGM equivalent grade, upto 2009 batch is to be promoted at par with the proposal from SEA section for the CAO promotion. Similarly, JAO 2012 batch is promoted, so all the equivalent cadres are to be brought to that level. The proposal of Pers section is upto 2009 batch (upto 2010) for all the cadres. CMD reassured that this demand is fully justified. He also informed that he directed DIR(HR) and HR wing to work out on those lines ensuring parity for all, in all the future promotions. Further we requested to speed up JTO to SDE and AO to CAO promotions. For JTO to SDE promotion, the Hon Ernakulam HC order on method of preparation of AIEL creating hurdles and delay. The contempt petition is to be decided and that created further delay, CMD informed us. CMD was very unhappy on the contempt petition. We requested to take immediate decisions to end the deadlock situation so that all the eligible Executives can get their promotion and can fully focus on the revival of the company. CMD informed that more than 12000 Executives got the promotion now and positive results are expected from this month itself.

SDE(T) to AGM promotion orders issued for 3452 SDEs.

All the SDEs in seniority list number 5, 6 & 7 are covered by this order. Some SDEs in SC/ST category of list 8 also covered to maintain roster points. The contradictory orders from Hon SC and the court orders on reservations delayed the promotions for three years. As on 31.03.2018, only 1782 DE vacancies are available. For covering entire list 5, 6 & 7 and to make it undisputed, CMD and DIR(HR) agreed to create 3105 additional DE posts by upgradation of vacant SDE posts on matching savings. Our demand for upgradation of additional posts to cover full list 8 is not accepted by the management.

129 SC/ST Executives have been Promoted in addition to the 3452 List.

Creation of DE posts by upgradation of vacant SDE posts become possible only due to the fact that CPSU Hierarchy is approved and going to be implemented w.e.f 01.07.2018 where the promotions are delinked from availability of posts.
