The second CEC meeting of TN circle was held at Kanyakumari on 4-2-2017. National flag hoisted by Com Muthiyalu CWC member and SNEA flag hoisted by Com.S Balasubramanian Circle President. The CEC meeting was presided over by Com S.Balasubramanian Circle President. Com N.Albertsingh DS NGC proposed welcome address. Circle President delivered presidential address covering the functioning of circle assn, success in  MVP campaign, Rule 8 transfers, E2 E3 pay scales, promotions, posting of JTOs etc.
        Com. A.A.Khan CHQ President inaugurated the CEC meeting. In his speech CHQ President appreciated the TN circle for the victory in MVP . He addressed about the status of issues after the MVP, the danger of disinvestment, strategic sales, financial viability of BSNL, the latest situation in E2,E3 pay scales CPSU hierarchy, Superannuation benefit, social security issues, cadre name change and our two fold responsibility of strengthening the SNEA and profit making of BSNL he mentioned, JTO to SDE, SDE to DE, DE to DGM promotions merger of Civil and Electrical wings with main stream and problems in accounts wings, LDCE, Rule-8 transfer cases,  pending the HR issues.
        Shri K.Saju Geroge GM NGC delivered his special address. He mentioned that the telecom field now is turbulant situation.The dangers of JIO he cautioned. The MNP is positive and in NGC it is 5 :1, he appreciated. Positive mind feeling, team work, effective utilisation of available  resources, manpower  he covered in his motivational speech. He insisted to create some examples of excellence in our work.
        Circle Secretary presented his report  for the period 23-4-2016 To 3-2-2017. He covered the local agitations during this period in STR, Tuticorin, Madurai, Salem, Tirunelveli, Coimbatore and  Erode. He informed the work done during the MVP through out TN and our success in transfer and posting were also informed. The re-allottment of DGM postings, Incoming DEs posting, Posting of  LICE and offg JTOs, Rule -8 transfers, achieving the request transfers with in 11 months a major breakthrough in transfer policy were pointed out.
            Com R.Rajan CHQ Treasurer greeted the CEC and explained the MVP, 3rd PRC and subscription deduction forms collection by DSs. 
The CEC ended at 20-40 hrs with Vote of thanks by Com Rose Cyril Xavier, CWC member which followed by National Anthem.
Pay protection on Offtg promotion for the JTO/JAO/SDE/AO/AD(OL)s etc officiated as SDE/AO/DE/CAO etc in DoT/BSNL: The proposal for protection of the pay drawn during Officiating promotion is approved by CMD on 23.02.2017 as assured to us. The orders are expected tomorrow.



The proposal to constitute a Committee to deliberate on our suggestion for Term Insurance as social security for the BSNL direct rects is approved by DIR(HR). Letter will be issued in a day or two.

Salient features of 3rd PRC recommendations:
a) Fitment benefit: Uniform fitment of 15% on Basic + IDA.
If the additional financial impact on the average of last 3 years PBT (Profit Before Tax) is less than 20%, the fitment will be 15%. If it is more than 20% but less than 30%, the fitment will be 10%. If it is more than 30% but less than 40%, the fitment will be 5%. If it is more than 40%, the fitment will be NIL.
b) Annual increment: 3%
c) Promotion Increment: 3%.
d) Pay scales:

e) Stagnation increment: One increment after every two years, upto a maximum of 3 such increments.
f) IDA as on 01.01.2017: 100% neutralisation on 01.01.2017.
g) HRA: 24%, 16%, 8% in place of existing 30%, 20% and 10%. The HRA will be revised to 27%, 18% and 9% when IDA crosses 50% and further revised to 30%, 20% and 10% when IDA crosses 100%.
h) Superannuation benefits: It has to be under defined contribution scheme instead of defined benefit scheme.
i) Ceiling of gratuity to be enhanced from Rs 10 lakhs to Rs 20 lakhs from 01.01.2017. The ceiling of gratuity shall increase by 25% when IDA crosses 50%.
ii) The current limit of 30% of Basic pay +IDA will continue.
iii) The minimum qualifying service of 15 years not to be mandated for contributory pension. However it will be mandatory for medical benefits.
i) Date of effect: 01.01.2017 for pay scales, benefits and allowances.
j) Retirement age: No change.
k) Periodicity: Not later than 10 years, in line with Central Govt employees. Under no circumstances periodicity of wage revision for workmen should be less than the periodicity of the Executives.

The SNEA proposal for Term Insurance for the BSNL rects is under consideration of management. Restg Cell moved a proposal to constitute a Committee to have deliberations on the issue. The proposal is send to DIR(HR) for approval.
Similarly our proposal for formation of Corpus Fund is send to Estt cell for collecting the data pertaining to all the employees through ERP.
Pay protection on Offtg promotion for the JTO/JAO/SDE/AOs officiated as SDE/AO/DE/CAO in DoT/BSNL: The proposal for protection of the pay drawn during Officiating promotion is cleared by DIR(HR) and send to CMD for approval. GS, President and AGS met CMD today and requested to approve the proposal. CMD assured to approve the same immediately.
In fact the provision for pay protection has been withdrawn by BSNL on 19.02.2010 through a clarification. This resulted reduction of pay by two to three increments and recovery of lakhs of rupees for thousands of Executives. Assn was opposing the same and demanding the restoration of pay protection.

Implementation of Standard pay scales of E2 and E3 w.e.f 01.01.2007 replacing the intermediary pay scales of E1A and E2A.
Considering the latest developments in DoT on standard pay scales, the CWC at Hyderabd decided to organise trade union programmes immediately in the month of March itself. Considering the financial year ending, initial programmes will be at Delhi and major locations. Further intensified agitational programmes will be started from April, 2017. Notice will be issues in a couple of days.
Gear up for the struggle to get the pay scales finalised before the 3rd PRC implementation.

The proposal for merger of MTNL with BSNL is again on cards. According to reliable sources, PMO has initiated the process. The MTNL market liability will not be transferred to BSNL and MTNL employees will be given option to get absorbed in BSNL on BSNL pay scales and pay. Further details are awaited---

JTO to SDE promotion under SCF before Hon. High court of Kerala:
JTO TO SDE CASE AT ERNAGULAM COURT STATUS 

Detailed arguments for the above case were continued for the entire three days on 15, 16 and 17th Feb. As the matter was pertaining to three writ petitions, it was heard at length by the Senior Counsel.
From BSNL side, Senior Counsel from New Delhi appeared for all the 3 days and on behalf of SNEA, Senior Counsel Shri O.V.Radhakrishnan argued the case.  SNEA Kerala Comrades - Circle President, District Secretary Ernakulam, Assistant District Secretary Ernakulam and two SNEA Comrades from Hyderabad were present in the Court for the whole 3 days.
There was no written submission or appearance on behalf of AIBSNLEA for obvious reasons.
Direct Recruits who are recruited after 2001 challenging the seniority assigned to JTOs recruited between 1996 and 2000 were represented by three Counsels. CP, CS, CT and other office bearers of AIGETOA were also present in the court.
Today at 4.30 PM, the arguments concluded and the Hon. High Court reserved the case for pronouncing judgement.

RULE 8 CLARIFICATION REGARDINGS

Sub: Rule-8 transfers in the cadre of JTOs and amendment of Para-9 in BSNL Transfer policy.
Respected Madam,
A) We want to draw your kind attention towards pending Rule-8 transfers in various Circles in the cadre of JTOs. There are instances where the JTOs have completed more than 10 years in their present Circle and are waiting for their transfer. They have all along been working in extremely harsh climatic and geographical conditions since their recruitment and are unable to go to their Circle of choice.
Recently three LICEs from Group C to JTO cadre have been conducted on all India basis. Adequate number of JTOs will be getting posted in almost all the Circles. Inspite of the fact that Circles are getting good number of JTOs in their Circles, CGMs are not operating their waiting list of Rule 8 transfers of JTOs. This is being reflected very badly on the psyche of these JTOs. We earnestly request the management to issue instructions to field units for considering their Rule 8 request transfers as and when JTOs are joining through the LICE.
B) Recently Restructuring Cell vide their letter No. 6-1/2007-Restg. Vol.-III(Pt.) dated 19.12.2016 have issued some amendments related to provisions of Para-9 of BSNL Transfer Policy. The clarification given in para-9 (a) (vi) is amended as follows:
“As per provision (a)(ii) of para 9 of transfer policy, an employee continues to maintain his lien in the parent recruiting unit(i/e parent Circle/SSA) on temporary transfer to different Circles. However, stay outside the Circle on temporary transfer will not be counted towards eligibility for consideration for transfer under Para 8, on the pretext of having lien in parent Circle”.
The date of effect of this order is 19/12/2016 and there are JTOs gone on transfer to other circles on deputation before 19/12/2016. Hence the amendment can‘t be made effective from a retrospective date as they are not being given a right of informed choice. Hence, it is requested that stay outside the circle on temporary transfer before 19/12/2016 may be counted towards eligibility for consideration for transfer under Para 8. The amendment dated 19/12/2016 may be implemented prospectively.

The court case filed by SNEA at Hon PCAT, New Delhi for the pay fixation under FR22(1)(a)(1) without the restriction of FR 35  for the officiating JTOs come up for hearing today and we got favourable judgment. The benefit extended to SNEA members as in the case of others. We met PGM(Estt) and held further discussions on its immediate implementation. Once judgment copy is received, it will be immediately endorsed to the Circles, PGM(Estt) assured. Our Jt Sec Com Arvind Dahiya was present in the court to pursue the case.
